Before you sign

  • Do an NTSA search on eCitizen: it shows the registered owner and whether the logbook is held by a lender.
  • Match the chassis and engine numbers on the car with the logbook.
  • Have a mechanic inspect it, and test-drive it before you pay.
  • Pay through the bank or M-Pesa, and start the NTSA transfer the day the full price is paid.

A template based on Kenyan law, not legal advice. Read every clause before signing.

About this tool

Enter the seller and buyer, the car's registration, chassis and engine numbers, the price and any deposit, and whether a bank still holds the logbook. You get a complete motor vehicle sale agreement: ownership and loan warranties, the NTSA transfer on eCitizen, who pays the transfer fee, condition and known defects, responsibility for fines and accidents after handover, and a handover record.

The outline and a before-you-buy checklist are free. The full agreement downloads in Word and PDF for a small M-Pesa payment.

Why a car sale agreement matters

Until NTSA registers the transfer, the seller is still the car's owner on record, so fines, accidents and even crimes involving the car can be traced back to them. A signed agreement with the date, time and mileage at handover is how both sides prove when responsibility changed hands.

How car transfer works in Kenya

  1. Search first. An NTSA search on eCitizen shows the registered owner and whether the logbook is held by a bank or SACCO.
  2. Sign the agreement and pay through a bank or M-Pesa, never in cash.
  3. The seller starts the transfer on the NTSA service on eCitizen, entering the buyer's details and paying the fee (or the buyer pays, as you agree).
  4. The buyer accepts the transfer from their own eCitizen account.
  5. The Traffic Act requires the change of ownership to be notified within seven days, so don't let it drag.

If the logbook is with a bank

Many cars are bought on loan, so the bank holds the logbook until the loan is paid. The template makes the seller clear the loan and get the logbook released before the buyer pays the balance, and lets the buyer pay part of the price straight to the lender.

Frequently asked questions

Does a car sale agreement need to be witnessed?

The law doesn't require witnesses for a car sale, but the template includes a witness for each party, which makes the agreement much harder to dispute later.

Who pays the NTSA transfer fee?

Whoever you agree. Many buyers pay it; the template asks you to choose.

What if I buy a car and it turns out to be stolen?

The template makes the seller promise the car isn't stolen or subject to any claim, and if it is, the seller must refund everything plus your reasonable costs. Always do an NTSA search and match the chassis and engine numbers before paying.
